These Terms of Service ("Terms") govern your access to and use of refer.soldhouse.com (the "Site"), operated by Sold House LLC ("SoldHouse," "we," "us," or "our"), and any deal referral or guide request you submit. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who may use the Site
The Site is intended for real estate professionals and property owners who are at least 18 years old and able to enter into a binding agreement. You agree to provide accurate, current information and to keep it up to date.
2. What SoldHouse is (and isn't)
SoldHouse is a real estate investor and cash homebuyer. SoldHouse is not a real estate brokerage and does not provide brokerage, legal, tax, or financial advice. Nothing on the Site is an offer to buy any specific property; any offer is made only in a separate written agreement after we evaluate a property.
3. Deal referrals
- When you submit a property, you represent that you have the right to share the information provided, including any property owner's information, and to be contacted about the referral.
- Submitting a referral does not create a partnership, agency, or employment relationship, and does not obligate SoldHouse to make an offer or pay any fee.
- You are responsible for complying with your brokerage's policies and all laws that apply to you, including real estate licensing rules and RESPA.
4. Referral fees
Any referral fee is governed by a separate written referral agreement between you and SoldHouse. Referral fees are paid only on completed transactions that actually close; amounts vary by deal and are not guaranteed. Referral arrangements with licensed real estate professionals may be regulated under RESPA and state real estate licensing laws, and it is your responsibility to confirm any arrangement complies with those rules and your brokerage's policies.
5. Free guides
Guides and other materials offered on the Site are provided for general educational purposes only, "as is," without warranties, and do not constitute legal, tax, financial, or professional advice. You are responsible for how you use them.
6. Acceptable use
You agree not to misuse the Site — including by submitting false information, infringing others' rights, uploading malware, attempting to gain unauthorized access, scraping, or interfering with the Site's operation.
7. Intellectual property
The Site and its content — including text, graphics, logos, and guides — are owned by SoldHouse or its licensors and are protected by law. We grant you a limited, revocable, non-transferable license to view the Site and download guides for your own professional use. You may not resell or redistribute our materials without permission.
8. Communications consent
By providing your contact information, you consent to be contacted by SoldHouse by phone, text, and email as described in our Privacy Policy. You can opt out of texts by replying STOP and of emails via the unsubscribe link.
9. Disclaimers
The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the fullest extent permitted by law, SoldHouse and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or any referral. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify and hold harmless SoldHouse from any claims, damages, or expenses arising out of your use of the Site, your submissions, or your violation of these Terms or applicable law.
12. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. You agree that any dispute will be resolved exclusively in the state or federal courts located in DuPage County, Illinois.
13. Changes
We may update these Terms from time to time. Changes take effect when posted, and continued use of the Site means you accept the updated Terms.
